Terms & Conditions

Terms & Conditions of Garden of Grace Photography

Effective Date: 01/01/2025

By booking or using the services of Garden of Grace Photography (“Photographer,” “we,” “our”), the Client (“you”) agrees to the following Terms & Conditions.

1. Booking & Payment

  • A signed contract and full session fee are required at the time of booking to secure your session date.

  • No date is officially reserved until both the contract and full payment are received.

  • All fees are non-refundable unless otherwise stated in writing.

2. Cancellations & Rescheduling

  • Payments are non-refundable.

  • Sessions may be rescheduled one (1) time with at least 48 hours’ notice, subject to availability.

  • Cancellations made with less than 48 hours’ notice may result in forfeiture of all payments.

  • In the event of photographer illness, emergency, or severe weather, sessions will be rescheduled at no additional cost.

3. Session Conduct

  • Clients are responsible for cooperation during the session.

  • Garden of Grace Photography is not responsible for uncooperative subjects, late arrivals, or missed shots due to circumstances beyond our control.

  • Session time begins at the scheduled start time; late arrivals may result in reduced shooting time.

4. Artistic Style

  • By booking, you acknowledge that you are familiar with and agree to the Photographer’s artistic style.

  • Editing, color tones, and creative choices are at the discretion of the Photographer.

  • RAW/unedited images are never provided.

5. Image Delivery

  • Final edited images will be delivered via an online gallery within 2 weeks of the session.

  • Turnaround times may vary during peak seasons.

  • Images are stored for 30 days/months after delivery; clients are responsible for downloading and backing up their files.

6. Copyright & Usage

  • Garden of Grace Photography retains full copyright to all images.

  • Clients receive a personal use license, allowing:

    • Printing

    • Sharing on social media (credit appreciated)

  • Images may not be altered, sold, or used commercially without written permission.

7. Model Release

  • Unless otherwise stated in writing, the Client grants Garden of Grace Photography permission to use images for:

    • Portfolio

    • Website

    • Social media

    • Marketing and promotional materials

  • Written notice must be provided before the session to opt out.

8. Liability

  • Garden of Grace Photography is not responsible for injury, loss, or damage during the session.

  • Clients assume responsibility for all participants, including children.

  • Liability is limited to the amount paid for the session.

9. Force Majeure

Garden of Grace Photography is not liable for failure to perform due to causes beyond reasonable control, including but not limited to acts of God, weather, accidents, or emergencies.

10. Image Archiving

  • While every effort is made to preserve images, long-term storage is not guaranteed.

  • Clients are encouraged to back up their images upon receipt.

11. Agreement

By booking a session, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
